Rugby Australia Media Accreditation Terms of Admission

Rugby Australia (Rugby AU) are pleased to present these terms to access game venues (Venues) for the 2025 Wallabies and Wallaroos Test Season and the British and Irish Lions Tour including matches, press conferences and related events in Australia (Events).

By applying for and accepting accreditation (Accreditation), the individual (Pass-Holder) and the firm, entity, company or organisation he or she represents (Principal) agree to comply with the terms described below. If the Pass-Holder is a sole trader, the Pass-Holder will be deemed as its own Principal for the purposes of these terms and conditions

1.General Obligations

1.1 Accreditation for the Events are issued by and are the property of Rugby AU. Rugby AU may grant, refuse, suspend, withdraw, revoke or cancel Accreditation to or for any person or Principal at any time and for any or no reason. In the event of an alleged breach of the terms and conditions, Rugby AU shall make all reasonable efforts to resolve the matter before any steps are taken by Rugby AU to suspend, withdraw, revoke or cancel the Accreditation. To the extent possible, Rugby AU will notify Pass-Holder with details of the alleged breach, and request rectification of such alleged breach. To the extent possible, Pass-Holder will be provided with a reasonable opportunity to rectify a breach after such notification. Any breach of these terms and conditions that is not rectified by Pass-Holder and/or Principal in accordance with this clause 1.1 shall result in Rugby AU suspending, withdrawing, revoking or cancelling Pass-Holder’s Accreditation.

1.2 Pass-Holder must be employed or engaged by or specifically supply a recognised Rugby, sporting, or news service or publication.

1.3 Accreditation for the Pass-Holder is for the sole purpose of producing coverage of and/or reporting on the Events (in accordance with clause 3.5) for or on behalf of the respective media organisation and/or for editorial news-related purposes by third parties. Rugby AU has the right to audit Pass-Holder at any time to ensure compliance with this clause 1.3. This may for example entail Pass-Holder being required to provide Rugby AU with evidence that images of the Events taken by Pass-Holder have been used for purposes described in this clause 1.3.

1.4 Accreditation is strictly non-transferable and non-assignable without the prior written approval of Rugby AU.

1.5 Accreditation must be worn or displayed by the Pass-Holder at all times as a condition of entry into and remaining in any accredited area in the Venues and/or other location prescribed by Rugby AU. Pass-Holders must comply with directions from any official or representative of Rugby AU and the rules relating to the applicable Venue. Without limiting the foregoing, Pass-Holders and Principals must comply with, and their rights and obligations in connection with their Accreditation will be subject to, Rugby AU and the relevant Venue’s directions and rules relating to health, safety, social distancing, personal protective equipment and government public health restrictions and guidelines.

1.6 The Pass-Holder must behave in a respectful manner and must not cause offence to, or otherwise inhibit the enjoyment of other media, rights holders, players, teams or spectators.

1.7 By accepting Accreditation, the Pass-Holder agrees to, and will comply with, the relevant Venue’s terms and conditions of entry and any Rugby AU terms and conditions of entry. Access to the Venue will be refused, and accreditation removed, if Pass-Holder’s behaviour negatively affects the public standing of any Events or Rugby AU.

1.8 Pass-Holder must be at least eighteen years of age.

1.9 Pass-Holder and Principal shall not cause or permit the use of any material recorded by the Pass-Holder to be used in any way, which may challenge, damage, prejudice and/or undermine the intellectual property rights of or relating to Rugby AU, the Wallabies, the Wallaroos, the British and Irish Lions Tour and/or Rugby AU’s commercial program relating to an Event and/or which may assist ambush marketing of Rugby AU or an Event to take place. For the avoidance of doubt, nothing in these terms and conditions of Accreditation affects the intellectual property rights of any Pass-Holder or Principal. In particular, these terms and conditions of Accreditation are not intended to be, and shall not be interpreted as, undermining editorial independence or preventing the exercise of journalistic practices including and not limited to reporting, comment, review and criticism.

1.10 Pass-Holder agrees that any non-public information he/she obtains by virtue of being accredited will only be used for bona fide news reporting and will not be used by any person for betting in relation to an applicable Event.

2. Content: Text

2.1 Subject to 2.2, Pass-Holder and Principal may produce written material at Venues relating to an Event (Text) for supply to and publication in any distribution platform including, but not limited to; newspapers, magazines, periodicals and other printed products and/or radio and television broadcasts, websites or mobile that provide genuine news reporting or on news services.

2.2. Pass-Holder and Principal agree that they shall not commercially exploit Text other than for genuine news reporting purposes (or for official broadcast production businesses (BPB), as contemplated under the rights agreement or any other agreement between the BPB and Rugby AU. BPBs will ensure that Text which BPB supplies to a third party is used in accordance with 2.1 and 2.2.)

3. Content: Photographs, Video and Audio

3.1. Subject to 3.4 and 3.5 the Pass-Holder and Principal may take, publish and supply, still images taken by them within the Venue (Photographs).

3.2. Pass-Holder and/or Principal shall not, for commercial use or otherwise, take or produce at Venues, and distribute or transmit via any media or device, any moving image (or series of single still images capable of conversion into a moving visual image) or moving film of any aspect of any Event (Video) except (i) in connection with the outside broadcast and production of the Events, (ii) as otherwise permitted under the applicable rights agreement or any other applicable agreement with Rugby AU, (iii) to record and/or transmit Rugby AU media conference or Captain’s Run, or (iv) otherwise with the express written consent of Rugby AU.

3.3. Pass-Holder agrees not to record and/or transmit any sounds, commentary or verbal description of an Event from any Venue (Audio) except as permitted under the applicable rights agreement, for Rugby AU media conferences or with the express written consent of Rugby AU.

3.4. Pass-Holder and Principal agree that Photographs shall not be used in any manner that falsely, misleadingly or deceptively implies an endorsement or sponsorship of or with the Events, the Wallabies, the Wallaroos, the British and Irish Lions Tour, The Rugby Championship, the World Rugby Pacific Four Series or any member of the Wallabies, the Wallaroos, any team participating in the British and Irish Lions Tour and/or Rugby AU.

3.5. Unless the Pass-Holder has Rugby AU’s prior written consent to the contrary, Photographs may only be used for the following purposes: a. reporting news, sports and current affairs in newspapers, magazines, periodicals and other forms of print media; b. reporting news, sports and current affairs or news services via television broadcasts, mobile and/or tablet devices or websites that provide genuine news reporting services. Such Photographs shall not be used in a manner to emulate broadcast video or other moving visual images. Further, Photographs must not be made available on a commercial basis for any purpose not expressly stated herein including, but not limited to, downloading/copying for wallpaper, screen saver or multimedia messaging services, unless a right to do so is granted in any agreement between Principal and Rugby AU; c. aggregated internal and/or external databases; d. online photographic agency distribution websites for the purposes of sales/syndication in the normal course of business; e. sales to the public of Photographs for personal use but only following Rugby AU ’s prior specific and written consent; and f. promoting coverage of the Events in the manner contemplated under any agreement between Principal and Rugby AU.

3.6. Pass-Holder and/or Principal shall be responsible for obtaining all necessary third-party consents in relation to the permitted use of any photograph.

3.7. Photographs taken at or in relation to an Event must not be altered or adjusted other than in the course of the normal journalistic or editorial practice, such as cropping or manipulation for the purpose of formatting or superimposition of captions or headlines.

4. Other provisions

4.1 Nothing in these terms and conditions of Accreditation affect the Principal’s rights or entitlements under the Copyright Act 1968 (Cth) as judicially interpreted from time to time. For the avoidance of doubt, the intellectual property rights of any accredited individual, organisation or publication are only affected to the extent expressly set out in these terms and conditions. Rugby AU agrees that all copyright in material created by the Pass-Holder, including newspaper or news agency representative at Events will be owned by the Pass-Holder and/or Principal.

4.2 Pass-Holder acknowledges that he/she shall move in and around the Venue subject to these terms and conditions, and at his or her own risk. Principal will be responsible for the acts, omissions and negligence of the Pass-Holder in connection with these terms and conditions.

4.3 Principal agrees to indemnify Rugby AU and its employees, officers and agents against any loss, claim, expense or damage to Rugby AU or its employees, officers or agents resulting from a breach of these terms and conditions of Accreditation by Pass-Holder or Principal, or resulting from the acts, omissions or negligence of the Pass-Holder of Principal.

4.4 These terms and conditions are governed by the laws of New South Wales.

4.5 The Pass-Holder and Principal acknowledge they have read, understood and agreed to the terms and conditions set out above.

4.6 Nothing in these terms and conditions shall limit or interfere with an official BPB’s rights under the applicable rights agreement or any agreement between the BPB and Rugby AU. BPBs and their Pass-Holders each agree to comply with these terms and conditions, the applicable rights agreement or any agreement between the BPB and Rugby AU at all times when accessing Venues for Events. In the event of any inconsistency between these terms and conditions, the applicable rights agreement or any agreements between the BPB and Rugby AU, the rights agreement and then any agreements between the BPB and Rugby AU will prevail.
