The following terms and conditions (Terms) apply to all users (You or Your) of Rugby Australia's (Rugby AU's) media website, the HSBC Sydney Seven’s website and any mobile version of rugbyau.com (Rugby AU Website). By using Rugby AU's Website, You agree to comply with these Terms.
1. Intellectual Property
All content on theRugby AU Website belongs to Rugby AU and/or its suppliers. Rugby AU reserves all rights to protect is intellectual property as it deems appropriate.
All copyright in the text, images, graphics, interfaces, and other content on Rugby AU's Website, and the arrangement and coordination of all such content, are owned or licensed by Rugby AU. You may view the Rugby AU Website and its content, but You may not copy, compile, reproduce, modify or distribute any of the Rugby AU Website content for any reason without the express written permission of Rugby AU.
The Rugby AU Website displays numerous trade marks owned by Rugby AU, state rugby organizations, Rugby AU sponsors and other third parties in Australia and internationally. You may not use any of the trademarks appearing on the Rugby AU Website without the express written permission of Rugby AU or the relevant trade mark owner.
2. Third Party Links
The Rugby AU Website contains links to third party websites. Such links are provided for convenience only. By providing links to third party websites, Rugby AU does not endorse the products or services offered through such sites, nor is Rugby AU's responsible for the content appearing on such sites.
Rugby AU welcomes the use of Rugby AU’s logo, as may be updated from time to time, on third party websites as a link from those sites to Rugby AU’s website (www.rugby.com.au), subject to Rugby AU's approval at all times.
3. Your Conduct
As a condition of Your use of the Rugby AU Website, You warrant to Rugby AU that You will not use the Rugby AU Website for any purpose that is unlawful, inappropriate or otherwise contrary to these Terms. In particular, You agree not to:
use the Rugby AU Website for any activities, or submit via the Rugby AU Website any information or materials, which breach any laws or regulations or infringe a third party's patent, trade mark, copyright or other proprietary rights or privacy;
publish, distribute or disseminate on the Rugby AU Website any material which is unlawful, obscene, defamatory, indecent, offensive, threatening, inappropriate or racially, ethnically or otherwise objectionable;
promote any unsolicited advertising, promotions, materials, surveys, contests or unauthorised services via theRugby AU Website;
impersonate any person or entity;
upload or post files or material that contains software viruses or any other computer code designed to interrupt, destroy or limit the functionality of any computer software or hardware;
download any file posted by another user of theRugby AU Website that You know or reasonably should know cannot be legally distrusted in such a manner; or
undertake any conduct that violates any Rugby AU policies or, in Rugby AU’s sole discretion, restricts or inhibits any other user from using or enjoying the Rugby AU Website.
By posting or submitting content to the Rugby AU Website, You represent and warrant that (i) You own all the rights to the content or are authorised to use and distribute the content via the Rugby AU Website; and (ii) the content does not and will not infringe any intellectual property rights, any applicable law or regulation, or any of the warranties made by You above.
reserves the right to pre-screen content submitted for publication on the Rugby AU Website. Rugby AU may refuse to publish or remove content that, in its sole discretion, does not meet its standards or does not comply with the Terms.
You will indemnify Rugby AU, its employees, agents and representatives from any loss or damage including consequential loss or damage which may arise from Your use of the Rugby AU Website or from any breach by You of these Terms.
While Rugby AU aims to provide accurate and truthful information at all times, Rugby AU makes no warranties or guarantees with respect to the accuracy, suitability, reliability or timeliness of the information, software, products or services included in or available through the Rugby AU Website. Any information or advice obtained from the Rugby AU Website should not be relied upon for personal, medical, legal or financial purposes and You should consult an appropriate professional for specific and personalized advice. All content on the Rugby AU Website, as well as these Terms, are subject to change and may be updated by Rugby AU at any time in its sole discretion. To the full extent permitted by law, in no event shall Rugby AU, its agents or suppliers be liable for any direct, indirect, punitive, special or consequential damages whatsoever arising from or in any way connected with the use of the Rugby AU Website.
These Terms are governed by the laws of New South Wales, Australia, and You agree to submit to the exclusive jurisdiction of New South Wales courts in resolving any issues or disputes arising under these Terms. Unless otherwise specified herein, these Terms constitute the entire agreement between You and Rugby AU in regards to Your use of the Rugby AU Website.
Nomination and Selection Criteria for the 2019 Australian Pacific Games Team
Quota Restrictions & Australian Team Size
The Organising Committee has imposed a maximum limit of athletes per national competing at the 2019 Pacific Games in Samoa.
2. NOMINATION BY RUGBY AUSTRALIA
To be nominated to the Australian Olympic Committee (AOC) by Rugby Australia for selection to the Samoa 2019 Pacific Games Australian Team, the Women’s Rugby Sevens Head Coach and Rugby Australia’s Sevens National Selection Panel will consider factors including, but not limited to:
(a) the current form of the athlete;
(b) recent performances at international level;
(c) national/international experience of the athlete;
(d) the athlete’s performance and discipline in national centralized program and future camps and tournaments;
(e) current level of health and fitness of the athlete;
(f) team compatibility on and off the field; and
(g) specific positional requirements to achieve optimal team balance.
For the avoidance of doubt, the final decision regarding nomination to the AOC for selection will be made by the Women’s Rugby Sevens Head Coach.
Timing: Rugby Australia will nominate athletes for selection to the AOC when required by the AOC, but no later than 5pm AEDT on Monday, 13 May 2019.
3. SELECTION BY THE AOC
To be selected by the AOC as a member of the Samoa 2019 Pacific Games Australian Team, each Athlete must:
(1) have been nominated by Rugby Australia for selection by the AOC in accordance with Clause 2 of these Guidelines;
(2) have signed (or if a minor, parent or guardian have signed) the Samoa 2019 Pacific Games Team Membership Agreement and agree to sign any entry form required by the Organising Committee for the 2019 Pacific Games;
(3) have observed and continue to observe the provisions of the AOC’s Constitution, Ethical Behaviour By-Law and must not have breached the AOC’s Anti-Doping By-Law unless the athlete has already been sanctioned for the breach and has completed the sanction imposed. A copy of AOC’s By-Laws are available from olympics.com.au;
(4) undergo medical assessment and testing (if requested) to the complete satisfaction of the AOC;
(5) have disclosed information to Rugby Australia or the AOC concerning any conduct that might breach the code of conduct required of Athletes selected to an Australian Pacific Games Team under the Samoa 2019 Pacific Games Team Membership Agreement; and
(6) acknowledge that any matter arising under clauses (1) – (5) above is to be determined, or breach thereof excused, by the AOC in its sole and absolute discretion.
If, in the opinion of the AOC, an Athlete fails to comply with one or more of the requirements in (1) – (6) above, that Athlete will be ineligible for selection by the AOC.
Rugby Australia will nominate athletes to the AOC for selection to the 2019 Pacific Games Team. The AOC has the sole and absolute discretion:
(1) to determine whether an Athlete (or team where applicable) has met the requirements of selection; and
(2) to determine whether or not it should select the maximum number of Athletes (or teams where applicable) permitted by the Organising Committee, notwithstanding the number of Athletes who may have met the requirements of selection.
If an Athlete breaches any of the requirements of this Nomination and Selection criteria, the AOC may suspend or terminate the Athlete’s selection to the Team or otherwise impose a sanction prescribed by the disciplining procedures set out in the 2019 Pacific Games Team Membership Agreement.
6. NO APPEAL GROUNDS
The appeal mechanism set out in the AOC Olympic Team Selection By-Law does not apply to the 2019 Pacific Games Team.
